Establish authority before transferring the title

1. 01Identify the lawful signer

   For an out-of-state title in the deceased owner’s name, New York says the transfer must be made by an executor or administrator. Match the signer to the court-issued authority.

2. 02Preserve the title chain

   The executor or administrator signs the title and identifies the estate capacity. Keep the supporting Letters with the transferred title; do not use a New York next-of-kin affidavit as a substitute for an out-of-state title transfer.

3. 03Build the New York packet

   Use the MV-843 checklist to assemble the ownership, death, tax or exemption, insurance, application, identity, and fee records that match the actual estate path.

4. 04Pause disputed or unclear estates

   If authority, beneficiaries, vehicle value, liens, or competing ownership claims are unclear, obtain estate or legal guidance before signing or submitting vehicle documents.

Keep the record that proves each handoff

• Original out-of-state title in the deceased owner’s name
• Title assignment signed by the executor or administrator in that capacity
• Letters Testamentary or Letters of Administration matching the signer
• Copy of the death certificate or certification of death
• New York MV-843 checklist and the applicable sales-tax or exemption record
• New York MV-82 application, identity evidence, and insurance proof in the new registrant’s exact name
