Do I have to register my vehicle in Montana?

Montana's general nonresident vehicle exemption statute (MCA 61-3-302(2)) exempts a vehicle owned by a nonresident from Montana registration if it is validly plated/registered in the owner's home jurisdiction AND the nonresident owner is not employed or engaged in a commercial/business enterprise in Montana (outside their military duties). County motor vehicle offices (e.g., Butte-Silver Bow, Gallatin) confirm active-duty servicemembers stationed in Montana on orders from another state may instead choose to title/register in Montana and apply for Montana's military fee exemption via form MV53. If a nonresident servicemember becomes gainfully employed in Montana outside military duty, Montana registration is required.

(2) A motor vehicle, trailer, semitrailer, or pole trailer driven or moved upon a highway in this state and owned by a nonresident of this state is exempt from registration under this chapter if: (a) the vehicle is properly registered in and displays valid license plates of the jurisdiction in which the nonresident owner resides; and (b)(ii) the nonresident owner is not employed or engaged in a commercial or business enterprise in this state

Fee waivers and tax exemptions

Military registration fee exemption (Form MV53)

Active-duty servicemembers (including those on orders stationed in Montana from another state, or Montana-origin members stationed elsewhere) who submit form MV53, Application for Military Registration, signed by the member and a unit officer, may register a vehicle without paying certain Montana light-vehicle registration fees, fees in lieu of property tax, and county option taxes. A new MV53 must be submitted with each annual renewal or the exemption is removed.

Fee waiver for Montana resident on active duty stationed outside Montana (MCA 61-3-456)

A Montana resident (including National Guard/Reserve) on active military duty stationed outside Montana may register a vehicle for the cost of registration alone, exempt from certain other Montana taxes and fees referenced in the statute.

Renewal grace period while deployed

A Montana driver's-license renewal applicant who is stationed outside Montana on active military duty may renew by mail or online for as long as they remain on active duty, and a spouse or dependent of such an applicant may likewise renew the applicant's license by mail or online for one additional consecutive term following a mail/online renewal.

What to know as a new Montana resident

Montana has no general state sales or use tax, so the sales/use-tax-on-vehicles issue common in other states is generally not applicable when an active-duty member moves into Montana. For vehicle registration, a servicemember newly stationed in Montana who remains a legal resident of another state can rely on the nonresident exemption (MCA 61-3-302(2)) to keep the vehicle registered/plated in the home state instead of registering in Montana, provided they are not otherwise employed in a commercial/business enterprise in Montana; alternatively they may title/register the vehicle in Montana and use form MV53 to claim Montana's military fee exemptions.
