Do I have to register my vehicle in West Virginia?

West Virginia's vehicle-registration statute defines who counts as a 'resident' required to title/register a vehicle in West Virginia within 30 days of taking up residence, and it expressly carves out military personnel: a member of the Armed Forces stationed in West Virginia is not considered a West Virginia 'resident' for this purpose (and therefore is not required to register/title a vehicle in West Virginia) as long as the vehicle is properly registered in the member's actual state of residence. The same section also lets a West Virginia-domiciled servicemember stationed in another state or country keep that state's or country's registration instead of West Virginia's.

"Resident" does not include a person who is attending a college, university or other educational institution in this state, if the person has a domicile in another state and has a valid operator's license and vehicle registration issued by the state of domicile. "Resident" also does not include members of the Armed Forces that are stationed in West Virginia providing that their vehicles are properly registered in their state of residence or a member of the Armed Forces stationed in another state or country providing that their vehicles are properly registered in that state or country.

Can I keep driving on my current license in West Virginia?

West Virginia's general 'persons exempt from license' statute allows a nonresident who is at least 16 and has a valid home-state or home-country driver's license in their immediate possession to operate a motor vehicle in West Virginia as a noncommercial driver, but only for up to 90 days in any one calendar year (and only if the home jurisdiction extends the same reciprocal privilege to West Virginia residents). No separate West Virginia statute was found giving active-duty military an indefinite/unlimited nonresident driver's-license exemption comparable to the vehicle-registration carve-out in 17A-3-1a; Chapter 17B's definitions section (17B-1-1) defines only 'nonresident' generically and contains no Armed Forces-specific residency exclusion. A separate exemption in the same section covers a person operating a vehicle 'in the armed services of the United States' while performing official duties, which applies to official-duty driving rather than a servicemember's personal vehicle use.

Fee waivers and tax exemptions

Gold Star Family license plate registration fee exemption

A Gold Star spouse (a veteran's widow or widower eligible for a gold star lapel button under 10 U.S.C. 1126) or a Gold Star parent is exempt from all registration fees otherwise required under West Virginia's registration chapter for one Gold Star Family license plate for personal use. A surviving spouse may also continue using a deceased spouse's military license plate until the surviving spouse dies, remarries, or does not renew the plate.

Renewal grace period while deployed

A West Virginia driver's license does not expire on the normal eight-year (or 21st-birthday) cycle for a person in the Armed Forces; instead, it expires six months after the date the person is separated from active duty under honorable circumstances, effectively letting an active-duty resident's license remain valid for the length of their service without needing to renew it.

What to know as a new West Virginia resident

West Virginia's new-resident vehicle registration statute (17A-3-1a) requires a new resident to register/title a vehicle within 30 days of taking up residence, using a multi-factor rebuttable presumption of residency (voter registration, enrolling children in WV public schools, receiving WV public assistance, remaining in WV more than 30 days, WV employment, or filing a WV homestead exemption), but expressly excludes Armed Forces members stationed in West Virginia from that residency presumption as long as their vehicle remains properly registered in their actual home state. No separate official West Virginia source was found addressing a servicemember who affirmatively chooses to make West Virginia their new home of record/domicile (as opposed to being merely stationed there) and titles a vehicle previously titled elsewhere.
