The buyer did not transfer the Florida title
Start with the free official Notice of Sale. It can mark the title record sold and detach or remove the seller's registration information. It does not complete or compel the buyer's title application, and the seller's name remains in the database until the buyer submits the title for transfer.
File the notice and handle the remaining records
- 01File the Notice of Sale
File the seller's notice under section 319.22 within 30 days after the sale or transfer. Use the current official channel now if the deadline has passed, but do not assume a late or incomplete filing satisfies the deadline or limits liability. For paper, use HSMV 82050 Rev. 03/21 or the title's Notice of Sale section and follow current office or mail instructions. Notice use on HSMV 82050 is sections 1 and 3. Section 2 odometer disclosure is not part of Notice use.
- 02Use only verified buyer information
The posted HSMV 82050 sections 1 and 3 do not show a labeled field for the buyer identification required by section 319.22. Use MyDMV or ask an authorized office how to provide it. Never use an unlabeled field or guess. Keep sensitive buyer ID only in the seller's private official record; never enter buyer ID into NewState Drive.
- 03Keep the seller and buyer deadlines separate
The seller's Notice of Sale is due under section 319.22 within 30 days after sale or transfer. The buyer's title application is separately due under section 319.23 within 30 days after delivery. The title assignment and odometer duty are separate from Notice use, and section 319.225 has exemptions.
- 04Handle the plate separately
Remove the plate upon sale before delivery and formally transfer it to a replacement vehicle when applicable. Surrender it when moving out of Florida or canceling associated insurance. RS-43 says to surrender a valid plate and decal before canceling insurance, and separately permits a completed HSMV 82050 instead of surrender after disposal to prevent a financial-responsibility suspension. Filing HSMV 82050 does not always eliminate separate plate or insurance closeout. Contact an authorized office before changing insurance if the plate is active, on the vehicle, or unavailable.
- 05Keep your own copy
Save the exact completed notice or MyDMV confirmation with the sale record. FLHSMV TL-52 says the department does not retain HSMV 82050, so the seller's copy is the proof of what was submitted.
