Virginia lien release

Paid off your car in Virginia? How the lien comes off the title

Virginia DMV says the lender has 10 days to notify you and send the title showing the lien as satisfied. If the lender uses the Electronic Lien Program, it releases the lien automatically and DMV mails a clean title showing no liens to the address on file. If the lender does not participate, it signs and dates the lien release on the title and mails it to you, and you take it to a DMV customer service center to apply for a substitute title and remove the lien.

Your steps

Getting a clear Virginia title

Fee: $15 substitute title fee if a lien existed or a paper title was previously printed; a one-time paper title is free after an electronic lien release if it has not been printed already.

  1. Watch for a clean title from DMV after the payoff clears; if it has not arrived within seven business days after payoff, contact DMV.
  2. If your lender is not in the electronic program, get the title back with the lien release section signed and dated by the lienholder.
  3. Take the signed title to a DMV customer service center and apply for a substitute title so the lien is removed from DMV records.
  4. If the lender no longer exists, follow the DMV steps for an unavailable lienholder.

How long the lender has

Virginia gives the lienholder 10 days after payoff.

If the lienholder is out of business

Compare other states' procedures

Virginia DMV says that if the lender is unavailable you submit evidence that it went out of business (certification from the State Corporation Commission, the Motor Vehicle Dealer Board, or another licensing authority), documentation of your release request (such as returned certified mail), and a notarized statement identifying the vehicle by VIN, make, and year confirming the lien was satisfied. Separately, Va. Code 46.2-642 lets an owner who cannot get a release show DMV whatever evidence is available that the debt was paid, along with a sworn statement that it was paid.
