Georgia lien release

Paid off your car in Georgia? How the lien comes off the title

For an electronic lien, the owner contacts the lender, which releases the lien electronically (the DOR does not process electronic releases itself). For a paper title, the lienholder completes the Release section on the title (name as recorded, authorized signature, release date) and mails it to the next lienholder or, if none, to the owner. Georgia law gives the lienholder 10 days after satisfaction to execute and deliver the release. A DOR page says paper titles must be mailed within five days. If the title is unavailable, the lienholder may give the owner a completed and signed Form T-4 release.

What happens to the title in Georgia

Georgia DOR says lienholders with liens on fewer than 5 Georgia-titled vehicles may use paper titles, and those with more must use the Electronic Lien and Title (ELT) program, which gives participating lenders paperless titles.

Your steps

Getting a clear Georgia title

Fee: $18.00 title fee.

  1. After the final payment, contact the lender and ask it to release the lien (electronically if it uses ELT, or on the paper title's Release section).
  2. If you receive the paper title with the lien released, or a signed Form T-4 when the title is not available, take it with a completed title application (Form MV-1) to your County Tag Office; the County Tag Office may verify the T-4 before accepting your application.
  3. Pay the title fee, which the DOR lists as $18.00, and receive the new title showing no lienholder.
  4. If the title is electronic, ask the lender to confirm the electronic release; under the statute the state then prints and mails the certificate to the owner without a fee when the lender has an electronic agreement with the state.
  5. If the vehicle is 11 model years old or newer and the lien has been recorded for 10 years, or the vehicle is 12 or more model years old and the lien has been recorded for 4 years, no release is needed unless it is a mobile home, crane or vehicle over 10,000 pounds.

If the lienholder is out of business

Compare other states' procedures

Georgia DOR says the owner first searches for a merger or name change, then gets a letter from the appropriate state regulatory agency confirming the lienholder is no longer in business or is unlicensed; if the lienholder is unlicensed, the owner also sends a certified letter with return receipt to the lienholder's last known address. The owner submits the returned undelivered letter, the regulator's letter, the title and the $18.00 title fee. The statute (O.C.G.A. 40-3-56(b)) says an individual need not submit a release if the owner presents certification from the appropriate regulatory agency that the lienholder is no longer in business. This does not apply to individual lienholders, merged companies operating under new names, or entities not regulated by a state agency.
