Kentucky lien release

Paid off your car in Kentucky? How the lien comes off the title

Kentucky liens are recorded by notation on the title through the county clerk. After payoff the lienholder must file a termination (release) of the lien in the county where the lien was filed; the county clerk then marks the lien released in its system and on the title. A new title is not generated automatically when a lien is released, so the owner either takes the original title and the release to the clerk to have it signed off, or orders a duplicate title.

Your steps

Getting a clear Kentucky title

Fee: No fee to file a lien termination statement with the county clerk.

  1. Ask your lender for its lien release, which in Kentucky is a Title Lien Statement (form TC 96-187) signed by the lender.
  2. Take or mail the release and your original title to the county clerk where the lien was filed. The Kenton County Clerk says an office can fax a release to another county for $3.00.
  3. Have the clerk release the lien in the computer system, sign the lien off the title, and return the title to you.
  4. If you no longer have the original title or want a fresh title without the lien listed, order a duplicate title through your county clerk.

The lienholder must file the termination within one month after the loan is paid in full, or within 20 days after receiving the owner's signed written demand. Source: KRS 355.9-513 (as applied by county clerks to title liens); Webster County Clerk title lien page.

Compare other states' procedures

The Kenton County Clerk says that if the lienholder was a financial institution that was bought or merged, the clerk can accept a lien release from the new entity, but requires proof of the relationship between the two entities. For a dealership lienholder, it points owners to the Kentucky Motor Vehicle Commission, and it also mentions checking Secretary of State business filings or petitioning Circuit Court.
